Get the CELL Out strongly supports the reports of the PLUM and Public Works Committees ("Reports"), which recommend that the AGF Ordinance be amended in the following respects: </p> <ul type="disc"> <li class="MsoNormal">R<strong>emove the utility pole/light pole exemption</strong></li> <li class="MsoNormal">E<strong>xpand the notification requirements</strong></li> <li class="MsoNormal">E<strong>nhance existing aesthetic criteria</strong></li> <li class="MsoNormal"><strong>Impose permit duration limits</strong><b></b></li> </ul> <p class="MsoNormal">Get the CELL Out urges the Council to adopt the Report without delay. We would further request that the Council direct the following additional, reasonable amendments to the AGF Ordinance. </p> <ul style="margin-top:0in" type="disc"> <li class="MsoNormal"><u>Require that renewed permits fall under the requirements of the new ordinance:</u></li> <ul style="margin-top:0in" type="square"> <li class="MsoNormal">This provision is consistent with the San Francisco Ordinance, specifically Section 4.b.2 which states "The Department shall require that any Personal Wireless Service Facility installed in the Public-Rights-of-Way prior to the effective date of Ordinance No. 214-07 be subject to all of the requirements of this ordinance."<u></u></li> </ul> <li class="MsoNormal"><u>Enact that any pending application for a permit that is not final on the effective date of the ordinance shall be subject to the requirements of this ordinance</u>.</li> <ul style="margin-top:0in" type="square"> <li class="MsoNormal">This provision is consistent with San Francisco Ordinance, specifically Section 4.b.1 which states "any pending application for a permit under Chapter 11, Article 1, Section 11.9 (b) of the San Francisco Administrative Code that is not final on the effective date of this ordinance shall be subject to the requirements of this ordinance."</li> </ul> <li class="MsoNormal" style="color:#222222;background:white"><u>Expansion of the right of appeal to "all aggrieved persons"</u> </li> <ul type="square"> <li class="MsoNormal" style="color:#222222;background:white">Consistent with appeal rights under L.A. Zoning Code for CUPs/private property installations; currently, appeal of AGF permits in the PROW is only afforded to the limited number of owners/occupants who received notice -- a highly restrictive provision which stands alone among California cities. </li> </ul> <li class="MsoNormal" style="color:#222222;background:white"><u>Provision for public comment and/or a hearing <i>prior to permit issuance</i>, for all proposed installations in <i>residential zones</i></u></li> <ul type="square"> <li class="MsoNormal" style="color:#222222;background:white">Currently no such hearings are provided for. </li> </ul> <li class="MsoNormal" style="color:#222222;background:white"><u>Requirement for the applicant to provide an RF emissions analysis and/or a certification of compliance with FCC requirements</u> </li> </ul> <p class="MsoNormal" style="margin-left:1.0in;background:white"><span style="font-family:Wingdings">§<span style="font-size:7pt;font-family:'Times New Roman'"> </span></span><span style="background-color:white;background-repeat:initial initial">In 2011 the World Health Organization's International Agency for Research on Cancer reports that radio frequency electromagnetic fields are possibly carcinogenic to humans based on an increased risk for glioma, a malignant type of brain cancer associated with wireless phone use. </span><span style="color:#222222">An RF emissions analysis would appropriately inform stakeholders of their level of risk. </span></p> <p class="MsoNormal">Numerous large and/or nearby California cities include several of the above provisions in their ordinances governing PROW installations. During this meeting, residents presented Mr. Krekorian with demonstrated evidence proving that T-Mobile avoided numerous critical processes that would have allowed residents to challenge the installation. Residents also shared how they were further appalled to witness T-Mobile’s arrogance by their reckless management of the jobsite during construction, putting the neighborhood families and school children in danger. </b></div></div><div class="MsoNormal" style="font-family: Arial,Helvetica,sans-serif;"><br />
</div><div class="MsoNormal" style="font-family: Arial,Helvetica,sans-serif;">Mr. Krekorian promised residents he would focus his attention to this matter and vowed to maintain residents better informed. Among his promised action items, Mr. Krekorian said he would further review our contentions and address our concerns with T-Mobile in writing within a week, requesting that T-Mobile provide a response to those concerns within 14 days. </div><div class="MsoNormal" style="font-family: Arial,Helvetica,sans-serif;"><br />
</div><div class="MsoNormal" style="font-family: Arial,Helvetica,sans-serif;">Following the meeting, residents were left in the dark once again with no response from Krekorian’s office. On January 25<sup>th</sup>, it was a reporter asking for our comment that made us aware of <a href="http://www.scribd.com/doc/48245525/CD2-Paul-Krekorian-s-Letter-to-T-Mobile-regarding-Albers-Street-Installation" target="_blank"><span style="color: blue;">Krekorian’s letter to T-Mobile</span></a>. <b>Although we appreciate that a letter was sent from Krekorian’s office requesting T-Mobile’s response, we are disappointed to see that in his letter, Mr. Krekorian does not validate any of our claims and simply presents them to T-Mobile as “constituents’ concerns”.</b> Also missing in the letter were crucial points addressed at the meeting of greater importance than the “graffiti requirements” of the AGF. </div><div class="MsoNormal" style="font-family: Arial,Helvetica,sans-serif;"> </div><div class="MsoNormal" style="font-family: Arial,Helvetica,sans-serif;">In his letter, Mr. Krekorian should have made mention of the two protests, press rallies, 361 signed petitions, SONC support, and numerous community gatherings by community stakeholders opposing the tower who T-Mobile claims are the very customers that are to benefit from their 4G tower.</div><div class="MsoNormal" style="font-family: Arial,Helvetica,sans-serif;"><br />
</div><div class="MsoNormal" style="font-family: Arial,Helvetica,sans-serif;">On a side note, earlier this month, <a href="http://redcounty.com/content/los-angeles-city-council-25-million-budget" target="_blank"><span style="color: blue;">Red County reported</span></a> that even with a budget crisis at hand, the LA City Council ranks on top with perks, salaries and benefits at a cost to tax payers of $25 Million, about $1.6 Million per Council Seat. Yes, that $1.6M for CD2. Councilman Krekorian is paid generously at $178,789 per year and is provided with a car at City expense. We ask Mr. Krekorian and his staff to be our liaisons and help resolve this issue that has already taken so much of our personal time, energy and money as we struggle through this difficult economy.<br />

Our formal presentation included an 88-page bound book & DVD containing our contention and supporting documentation that the installation of T-Mobile's cell tower on Albers Street was executed with excessive violations of the Los Angeles Municipal Code and with reckless disregard for the neighborhood community. Several speakers presented the issue to the SONC Land Use Committe, and petitioned that the Committee vote on the following 3 motions:<br />

<blockquote><b>1. Publicly object to the T-Mobile AGF powering the Cell Tower on Albers Street on the grounds that T-Mobile failed to follow the required Specifications and Procedures per City of Los Angeles Municipal Code.<br />

</b></blockquote><blockquote><b>3. Join other Neighborhood Councils in the city-wide effort to enact a comprehensive new AGF/WTF ordinance with protections for communities and residential neighborhoods to the fullest extent of the law.<br />

On January 6th 2011, GetTheCellOut members met with Councilman Krekorian presenting a clear, concise, and itemized argument on why the cell tower should be removed. The Councilman was impressed with our presentation and receptive to our case. We are thrilled to report that he has committed to the following actions:</span></div><ul style="font-family: Arial,Helvetica,sans-serif;"><li><span style="font-size: small;">to propose to the city council that better notification and possibly ordinances be required from cell phone companies in the future, making reference to the possibility that changes could be retroactive as was done in the San Francisco case</span></li>
</ul><ul style="font-family: Arial,Helvetica,sans-serif;"><li><span style="font-size: small;">to draft a letter within the week listing the concerns of the Albers neighborhood to be presented to T-Mobile requesting an itemized response to those concerns within 14 days</span></li>
</ul><ul style="font-family: Arial,Helvetica,sans-serif;"><li><span style="font-size: small;"> to provide us with the city attorney's response to his request asking for a report on the extent of his authority to take action on the current cell tower installation</span></li>

It is very clear to us that it is T-MOBILE (privately owned by Deutsch Telekom) who is leading this deception in our American neighborhoods and in the process subcontracting the actual installation work to local companies like LINK ENGINEERING INC. We realize that Link Engineering is under contractual obligations with T-Mobile and therefore have no interest or need to enter into any discussions with Link.</span></span></div><div class="MsoNormal" style="margin: 0in 0in 10pt;"><span style="color: #333333; line-height: 115%;"><span style="font-family: Arial, Helvetica, sans-serif;"><span style="mso-spacerun: yes;"> </span><span class="textexposedshow">That being said, SINCE ABSOLUTELY NO CONTACT INFORMATION was posted on the jobsite, neighbors had no choice but to approach workers to inquire about the “public works project” with those onsite. Our neighborhood group, "Get the Cell Out!" has been involved in a contentious battle with T-Mobile and its construction company regarding this cell tower. Twice the LAPD and Department of Street Works were summoned when the group accused T-Mobile of trespassing on a homeowner's property and running a highly unsafe jobsite, including open, 20 foot deep trenches that children could easily fall into. The LA City Bureau of Contract Administration was also contacted to help assist control an unsafe jobsite, but very little was done.<br />

Residents are most angry with the lack of support of their City Councilman Paul Krekorian, who has been noticeably absent and whose office has not made any visible efforts to support residents or use his authority to stop the project. <br />
<br />
Sherman Oaks residents first contacted Paul Krekoran's office immediately upon learning about the Cell Tower construction on November 1st, sharing both concerns regarding the lack of proper notification and the dangerous jobsite conditions.<span style="mso-spacerun: yes;"> </span>However, the response issued by Pat Davenport, Field Deputy to the Council District 2 Office, was that little could be done as the office is overwhelmed due to lack of staff support.<br />

The Bureau of Engineering states that we missed our opportunity to appeal the installation of the cell phone antenna. Sadly, we were unable to appeal since we NEVER GOT notification. (Evidence now shows that none of our neighbors recieved notice as required by the Bureau of Engineering)<br />
